Terms of Service

Please read these terms carefully before using the PAKELP platform. By creating an account or using our services, you agree to be bound by these terms.

1Acceptance of Terms & Electronic Agreement

By accessing or using PAKELP ("the Platform"), operated by PAKELP (Pvt) Ltd ("Company", "PAKELP", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement made between you and the Company, concerning your access to and use of the Platform.

ELECTRONIC ACCEPTANCE

When you create an account, you are required to actively tick two separate, non-pre-selected checkboxes confirming that you have read and agree to (i) these Terms of Service and (ii) our Privacy Policy. You cannot create an account unless you do so. Ticking these boxes and clicking "Agree", "Sign Up", or "Create Account" — and, more generally, creating an account or using the Platform — constitutes your electronic signature and your express, informed consent to enter into a legally binding contract with PAKELP. You acknowledge that this manner of acceptance is valid and enforceable under the Electronic Transactions Ordinance, 2002 and the Contract Act, 1872, and that an electronic record and electronic acceptance shall not be denied legal effect merely because they are in electronic form.

These Terms are governed by the laws of the Islamic Republic of Pakistan, including but not limited to:

  • The Contract Act, 1872
  • The Electronic Transactions Ordinance, 2002
  • The Prevention of Electronic Crimes Act (PECA), 2016
  • The Anti-Money Laundering Act (AMLA), 2010
  • The Companies Act, 2017
  • The Consumer Protection Acts (Federal & Provincial)
  • The Income Tax Ordinance, 2001
  • State Bank of Pakistan Payment Systems Act, 2007
  • The Personal Data Protection Act (upon enactment)
  • All applicable provincial and federal laws of Pakistan

2Definitions

"Platform"The PAKELP website, mobile applications, and all related services.
"User"Any individual or entity accessing or using the Platform, including Customers and Service Providers.
"Customer"A User seeking services from Service Providers through the Platform.
"Service Provider"A business or individual offering services through the Platform.
"Content"All text, images, videos, reviews, ratings, messages, and other materials on the Platform.
"User Content"Any Content that a User submits, uploads, or posts, including profiles, portfolios, reviews, ratings, and messages.
"Public Profile"The profile information a User makes visible to others so that Customers can discover and contact Service Providers.
"Verification"The optional process by which a User submits identity documents (such as CNIC images and a selfie) to obtain a verification status.
"Services"The marketplace platform connecting Customers with Service Providers for discovery and communication only.

3Eligibility

To use this Platform, you must:

  • Be at least 18 years of age and have the legal capacity to enter into binding contracts under Pakistani law
  • Be a resident of Pakistan or otherwise legally authorized to use the Platform in Pakistan
  • Not be prohibited from using the Platform under any applicable laws
  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information

Additional Requirements for Service Providers (where legally applicable to your activity):

  • Any business registration, trade licence, or permit that the law requires for the specific service you offer
  • A valid National Tax Number (NTN) and Sales Tax Registration (STRN) where your income or turnover makes registration mandatory
  • Compliance with your own federal and provincial tax obligations

Many individual service providers (for example, tradespeople) are not required to hold business registration or tax numbers. These requirements apply only to the extent the law requires them for your particular activity. You are solely responsible for determining and meeting your own legal and tax obligations.

4User Accounts & Security

  • You must register with accurate details (your name, email address, and mobile number) and keep them up to date.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
  • You must notify us immediately of any unauthorized use of your account or any other breach of security.
  • You must not create an account using another person’s identity, create multiple or fake accounts, or transfer your account to anyone else without our consent.
  • We are not liable for any loss arising from unauthorized use of your account where you have failed to keep your credentials secure.

5Platform Role & Relationship Disclaimers

IMPORTANT LEGAL DISCLAIMER

PAKELP is solely a technology platform that facilitates discovery of, and communication between, Customers and Service Providers. We are NOT:

  • A party to any transaction, contract, or agreement between Customers and Service Providers
  • An agent, employee, or representative of any User
  • Responsible for the quality, safety, legality, or availability of services
  • Liable for any acts, errors, omissions, representations, warranties, breaches, or negligence of any User
  • Responsible for tax obligations arising from transactions between Users
  • A guarantor of any service, and we do not perform, supervise, or control any service
  • Liable for any personal injury, property damage, financial loss, or other harm arising from interactions between Users

No Employment Relationship

Nothing in these Terms creates an employer–employee relationship between PAKELP and any User. Service Providers are not employees, workers, or staff of PAKELP.

No Agency

No User is an agent of PAKELP, and no User has authority to bind, represent, or act on behalf of PAKELP. We do not act as an agent, broker, or intermediary for any User.

No Partnership or Joint Venture

These Terms do not create any partnership, joint venture, or franchise between PAKELP and any User.

Independent Contractors

Service Providers are independent contractors who are solely responsible for their own services, conduct, pricing, taxes, licences, and legal compliance.

All transactions and interactions between Customers and Service Providers are independent arrangements to which PAKELP is not a party. Any dispute arising from such arrangements shall be resolved directly between the concerned parties.

SERVICE PROVIDER INTERACTIONS DISCLAIMER:

When you contact, hire, visit, or interact with any Service Provider or other User found through PAKELP, you do so entirely at your own risk. PAKELP shall not be held responsible or liable for any incident, injury, loss, damage (physical, financial, or otherwise), dispute, fraud, misconduct, negligence, or any other outcome arising from your interaction with any User discovered through our Platform. This includes but is not limited to in-person meetings, service delivery, payment disputes, quality of work, property damage, personal safety incidents, and any misrepresentation by Users.

6Assumption of Risk & User Safety

PLEASE READ THIS SECTION CAREFULLY

BY USING THE PLATFORM, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE PLATFORM AND ANY INTERACTIONS WITH SERVICE PROVIDERS OR OTHER USERS IS ENTIRELY AT YOUR OWN RISK.

6.1 No Guarantee of Service Provider Conduct

PAKELP does not guarantee the behavior, actions, competence, honesty, reliability, or integrity of any Service Provider or user. While we may provide verification badges, ratings, and reviews, these do not constitute an endorsement, warranty, or guarantee of any kind. Verification only confirms that certain documents were submitted and reasonably matched — it does not guarantee the quality of service, professional ability, honesty, or trustworthiness of any individual or business.

6.2 Physical Interactions & Personal Safety

If you choose to meet, hire, or interact with any Service Provider or user in person, you assume full responsibility for your personal safety. PAKELP is not responsible for any harm, injury, theft, assault, property damage, or any incident that occurs during or as a result of any in-person meeting or service delivery arranged through the Platform. We strongly recommend that users take appropriate safety precautions including meeting in public places when possible, informing someone of your plans, and verifying the Service Provider's identity independently.

6.3 Financial Transactions & Losses

Any payment made directly to a Service Provider is a transaction between you and that Service Provider only. PAKELP is not responsible for any financial loss, fraud, overcharging, non-delivery of services, poor quality of work, or disputes arising from such payments. Users are advised to agree on prices, scope of work, and payment terms in writing before engaging a Service Provider.

6.4 No Warranty on Information Accuracy

Business listings, service descriptions, reviews, ratings, photos, prices, availability, and all other information displayed on the Platform is provided by Service Providers and users themselves. PAKELP does not independently verify this information and makes no warranty or representation regarding its accuracy, completeness, reliability, or currentness. Users should independently verify all claims and information before making any decisions based on Platform content.

6.5 Third-Party Links & External Services

The Platform may contain links to third-party websites, social media profiles, or external services provided by Service Providers. PAKELP is not responsible for the content, accuracy, safety, or practices of any third-party site or service. Accessing such links is at your own risk.

6.6 Service Quality & Outcomes

PAKELP does not guarantee the outcome, quality, timeliness, safety, or legality of services provided by Service Providers. We do not guarantee that services will meet your expectations or requirements. Any claims regarding service quality, defects, delays, or dissatisfaction must be addressed directly with the Service Provider.

6.7 Platform Availability

PAKELP does not guarantee uninterrupted or error-free access to the Platform. We may experience downtime for maintenance, updates, or due to circumstances beyond our control. We are not liable for any loss or damage resulting from Platform unavailability.

7Identity Verification

Identity verification is optional. Users — primarily Service Providers who wish to display a verification badge — may choose to verify their identity by uploading an image of the front and back of their CNIC/NICOP and a selfie. Verification is not required to create an account.

7.1 What Verification Means

Verification only confirms that the documents submitted reasonably match the person who submitted them. It does NOT guarantee the honesty, competence, skill, professionalism, trustworthiness, or future conduct of any User, and it is not an endorsement or warranty by PAKELP.

7.2 Consent & Purpose Limitation

By submitting verification documents, you expressly consent to our collecting and processing them solely to confirm identity and to prevent fraud and duplicate accounts. We do not use your selfie for facial-recognition profiling or for any purpose beyond one-time identity matching.

7.3 Secure & Restricted Storage

Verification documents are stored securely in an access-controlled location, separate from your Public Profile, and are accessible only to a limited number of authorized personnel for verification and fraud-prevention purposes. As with our other data, they may be stored on cloud infrastructure located outside Pakistan, subject to appropriate safeguards (see our Privacy Policy).

7.4 Fraud & Duplicate Detection

We may retain your CNIC number and compare submitted documents against existing records to detect and prevent duplicate, fake, or fraudulent accounts. Uploading a forged CNIC, using another person’s identity documents, or submitting false verification information is strictly prohibited and may be reported to the authorities, including the FIA.

7.5 Retention & Deletion

Verification documents are retained only for as long as reasonably necessary for verification, fraud prevention, and legal compliance, and are then securely deleted or anonymized. You may request deletion at any time, subject to our need to retain limited records to prevent re-registration fraud or to comply with law.

7.6 Never Public

Your CNIC images, CNIC number, and selfie are never displayed on your Public Profile or shared with other Users. Only your verification status may be shown.

8Public Profile & Disclosure

The Platform works by making certain information publicly visible so that Customers can discover and contact Service Providers. By creating a service profile and choosing to display your details, you acknowledge and consent that the following information may be visible to other Users and the public, and may be indexed by search engines:

Name or business name
Profile photo
Phone number (where you choose to display it)
Service details and category
City and area
Ratings and reviews
Portfolio images
Experience
Business information
Availability

If you choose to display your phone number, it will be visible to others so they can contact you directly. Do not publish any information you are not comfortable making public. Your CNIC images, CNIC number, selfie, password, and email address are never part of your Public Profile.

9User Conduct & Prohibited Activities

Users agree NOT to:

Violate any laws of Pakistan, including the provisions of PECA 2016
Provide false, misleading, or fraudulent information
Upload a fake or forged CNIC, or use another person’s identity or documents
Impersonate any person or misrepresent your affiliation with any person or entity
Create fake, duplicate, or unauthorized accounts
Scam, defraud, deceive, or financially harm other Users
Harass, threaten, stalk, abuse, or engage in hate speech against others
Post, manipulate, or incentivize fake reviews or ratings
Collect, scrape, or harvest User data without consent, or use bots or automated means
Reverse engineer, decompile, or attempt to gain unauthorized access to the Platform
Distribute spam, malware, viruses, or other harmful code, or engage in phishing
Offer or solicit illegal services, weapons, drugs, or other unlawful goods or services
Engage in human trafficking, child exploitation, or any content that sexualizes minors
Engage in money laundering or terrorist financing activities
Infringe any intellectual property, privacy, or other rights of any person
Share obscene, defamatory, or blasphemous content as prohibited under Pakistani law
Engage in anti-state activities or spread content against the national interest of Pakistan

Violation of these terms may result in immediate account suspension or termination and legal action under applicable Pakistani laws, including referral to the FIA Cybercrime Wing where appropriate.

10Reviews, Ratings & User Content

10.1 Reviews & Ratings

Reviews and ratings must be genuine, based on a real first-hand experience, and must not be fake, incentivized, retaliatory, or manipulated. You must not post, buy, sell, or solicit fake reviews or attempt to manipulate ratings. You are solely responsible for the content of your reviews, including any defamatory, false, or unlawful statements, and you agree that PAKELP is not liable for reviews or ratings posted by Users.

10.2 Content Moderation

We may, but are not obliged to, monitor, review, moderate, edit, or remove any User Content at our sole discretion, including reviews, ratings, profiles, and messages that we consider to violate these Terms or applicable law. We are under no obligation to pre-screen User Content and are not responsible for User Content posted by others. Removal or refusal to remove content does not make us liable for it.

10.3 Your Content & Licence

You retain ownership of the content you upload. By posting User Content, you grant PAKELP a non-exclusive, worldwide, royalty-free licence to host, store, display, reproduce, adapt, and distribute that content only as necessary to operate, provide, secure, and promote the Platform. This licence ends when you delete your content or account, except to the extent the content has already been shared with others or must be retained by law. You represent that you have all rights necessary to grant this licence and that your content does not infringe any third-party rights.

11Communications & Consent

  • You consent to receive service and transactional communications from us (such as account, security, verification, and support messages) by email, in-app notification, and push notification. These are necessary to provide the Service and cannot generally be opted out of while your account is active.
  • We will only send you marketing communications with your consent, and you may opt out of marketing at any time using the unsubscribe link or your account settings.
  • The Platform provides in-app messaging so that Users can communicate. You must use messaging lawfully and must not use it to harass, defraud, spam, or share unlawful content.
  • We may access, store, and review messages and other communications where reasonably necessary to provide the Service, respond to reports, resolve disputes, ensure safety, or comply with law. You should not expect messages that are reported or that we are required to review to remain private.
  • Electronic communications sent through or in connection with the Platform satisfy any legal requirement that communications be in writing, in accordance with the Electronic Transactions Ordinance, 2002.

12Reporting Abuse & Fraud Prevention

If you encounter fraud, a scam, harassment, a fake profile, a forged CNIC, or any content or conduct that violates these Terms or the law, please report it to us at support@pakelp.com.

  • We review reports and may remove content, suspend or terminate accounts, and take other appropriate action.
  • We operate anti-fraud measures, including duplicate-identity detection, and may investigate suspected misuse.
  • We cooperate with the FIA Cybercrime Wing, PTA, courts, and other competent authorities as required by law.

13Service Provider Obligations

Service Providers on the Platform agree to:

  • Provide accurate and truthful information about themselves and their services
  • Hold and maintain any licences, permits, or registrations that the law requires for their service
  • Comply with their own tax obligations, including any filings required by the FBR where applicable
  • Deliver services as described and as agreed with Customers
  • Maintain professional standards and ethical business practices
  • Respond to customer enquiries in a timely manner
  • Honor quoted prices and service commitments
  • Maintain adequate insurance where required by law
  • Not engage in unfair competition or deceptive practices
  • Protect any customer data they receive and respect customer privacy
  • Comply with consumer protection laws (Federal and Provincial)

14Intellectual Property Rights

Platform Ownership

All rights, title, and interest in the Platform — including the website, mobile app, logo, design, source code, database, content, images, brand name, and trademarks — are owned by PAKELP or its licensors and are protected under Pakistani and international intellectual property laws, including the Copyright Ordinance, 1962, the Trade Marks Ordinance, 2001, and the regulations of the Intellectual Property Organization of Pakistan (IPO-Pakistan). You may not copy, reproduce, or exploit any part of the Platform without our prior written consent.

User Content License

You retain ownership of the content you upload. By posting content, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, display, reproduce, adapt, and distribute such content only as necessary to operate, provide, secure, and promote the Platform. We do not claim ownership of your content. (See Section 10.3.)

Copyright & Trademark Complaints

We respect intellectual property rights. If you believe any content on the Platform infringes your copyright or trademark, please contact us at support@pakelp.com with:

  • A description of the copyrighted work or trademark concerned
  • The URL or location of the allegedly infringing content
  • Your contact information and proof of your rights
  • A statement, made in good faith and to the best of your knowledge, that the use is unauthorized and that the information you have provided is accurate

We will review valid complaints and may remove infringing content in accordance with the Copyright Ordinance, 1962 and applicable law.

15Payments & Fees

The Platform is currently free to use for discovery and communication, and PAKELP does not currently process payments between Users. The following terms apply if and when we introduce paid features.

Future Paid Features

We may in future introduce paid features such as subscriptions, paid or featured listings, advertisements, premium memberships, or commissions. Any such fees will be clearly disclosed to you before you incur them, and your use of a paid feature will be subject to any additional terms presented at that time.

Payment Processing

Where paid features are offered, payments would be handled by third-party payment processors regulated by the State Bank of Pakistan (SBP). By using such services, you would agree to the payment processor's own terms and conditions. We do not currently store card or wallet data.

Tax Obligations

Each User is solely responsible for their own applicable taxes, which may include:

  • Federal and provincial sales tax (GST) where applicable
  • Income tax on earnings under the Income Tax Ordinance, 2001
  • Withholding tax where applicable under FBR regulations
  • Any other taxes payable under Pakistani law

Refund Policy

Any fees charged for platform features are non-refundable except where a refund is required by applicable consumer protection law. Where refunds are considered, they are handled on a case-by-case basis. To raise a billing query, please contact support@pakelp.com.

16Disclaimer of Warranties

"AS IS" AND "AS AVAILABLE"

TO THE MAXIMUM EXTENT PERMITTED BY PAKISTANI LAW, THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Platform will be uninterrupted, secure, error-free, or free of harmful components, or that any User, listing, review, or service will meet your expectations. Nothing in this section excludes any liability that cannot lawfully be excluded.

17Limitation of Liability

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY PAKISTANI LAW, PAKELP SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, business, goodwill, data, or use
  • Damages arising from your use or inability to use the Platform
  • Any conduct or content of any third party or other User on the Platform
  • Unauthorized access, use, or alteration of your content
  • Personal injury, property damage, or any harm resulting from interactions with Service Providers or other users
  • Any loss or damage caused by reliance on information, reviews, ratings, or content on the Platform
  • Failure of any Service Provider to deliver services as promised or agreed
  • Any scam, fraud, or misrepresentation by any User of the Platform

To the maximum extent permitted by law, our total aggregate liability to you for all claims arising out of or relating to the Platform shall not exceed the greater of (a) the total fees you paid to PAKELP in the twelve (12) months preceding the claim, or (b) PKR 10,000. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under Pakistani law, including liability for death or personal injury caused by our own gross negligence, or for fraud.

These limitations apply regardless of the theory of liability, whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not the Company has been advised of the possibility of such damages.

18Indemnification

You agree to defend, indemnify, and hold harmless PAKELP, its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, and expenses arising from:

  • Your violation of these Terms
  • Your violation of any third party rights
  • Your violation of any applicable Pakistani law or regulation
  • Your content or information provided to the Platform
  • Your use of services obtained through the Platform
  • Any dispute between you and other users
  • Any fraudulent or illegal activities conducted through your account

19Dispute Resolution

Governing Law

These Terms are governed by the laws of the Islamic Republic of Pakistan without regard to conflict of law principles.

Negotiation & Arbitration

Any dispute arising from these Terms shall first be attempted to be resolved through good faith negotiations within 30 days. If negotiations fail, the dispute shall be resolved through arbitration by a sole arbitrator under the Arbitration Act, 1940 of Pakistan. The arbitration shall be seated in Lahore, Pakistan, and conducted in the English language.

Jurisdiction

Subject to the above, the courts of Lahore, Pakistan shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the Platform.

20Privacy & Data Protection

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

By using the Platform, you consent to:

  • Collection and processing of your personal data as described in our Privacy Policy
  • Storage of data on cloud infrastructure that may be located outside Pakistan, with appropriate safeguards
  • Public visibility of your Public Profile information so that Customers can contact you
  • Use of cookies and similar technologies as described in our Cookie Policy

21Suspension, Termination & Account Deletion

21.1 Suspension & Termination by PAKELP

We may suspend or permanently terminate your account and access to the Platform, at our discretion and where reasonable without prior notice, for reasons including:

  • Violation of these Terms or applicable law
  • Fraud, scams, fake verification, or a forged or misused CNIC
  • Abuse, harassment, or illegal activity
  • Creating fake or multiple accounts
  • Serious or repeated complaints from other Users
  • Security reasons or extended inactivity (over 24 months)
  • A court order, government or regulatory request, or direction from PTA, FIA, or another competent authority

21.2 Account Deletion by You

You may delete your account at any time through your account settings or by contacting support@pakelp.com. When you delete your account, your Public Profile will be removed from public view. We will delete or anonymize your personal data, except where we are required or permitted to retain certain information — for example, records needed to comply with law, resolve disputes, prevent fraud or re-registration abuse, or that have already been shared with other Users (such as reviews or messages sent to others).

21.3 Effect of Termination & No Refund

Upon suspension or termination, your right to use the Platform ceases immediately. Where permitted by law, no refund of any fees is guaranteed. Sections that by their nature should survive termination will continue to apply (see Section 23).

22Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or Platform notification at least 15 days before changes take effect. Your continued use of the Platform after changes take effect constitutes acceptance of the modified Terms.

If you disagree with any changes, you must discontinue use of the Platform and may terminate your account. Previous versions of these Terms will be archived and available upon request.

23General Provisions

Severability

If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction in Pakistan, the remaining provisions shall continue in full force and effect.

Survival

Provisions that by their nature should survive termination will do so, including the Platform Role & Relationship Disclaimers, Identity Verification, Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Dispute Resolution, and Governing Law.

Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and PAKELP regarding the Platform and supersede all prior agreements.

Waiver

No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

Force Majeure

We shall not be liable for any delay or failure due to causes beyond our reasonable control including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, earthquakes, accidents, pandemics, strikes, internet or utility outages, or shortages of transportation, facilities, fuel, energy, labor, or materials.

Notices

All notices under these Terms shall be in writing and may be given by email, website notice, or in-app notification. Electronic notices shall constitute valid written notice under the Electronic Transactions Ordinance, 2002.

24Regulatory Compliance & Grievance Redressal

PAKELP is committed to operating within the regulatory framework of Pakistan. If you have a complaint that we have been unable to resolve, you may escalate it to the following authorities:

FIA Cybercrime Wing

For complaints related to electronic crimes, fraud, or cyber security issues under PECA 2016.

Pakistan Telecommunication Authority (PTA)

For complaints related to online content, telecommunication services, or platform operations.

Consumer Courts

For consumer protection complaints under the applicable provincial Consumer Protection Act.

Competition Commission of Pakistan

For complaints related to anti-competitive practices or unfair business conduct.
